FIFA Faces Challenges from the Court of Arbitration for Sport as Alajuelense Looks to Compete

With a potential World Club Cup spot at stake, Liga Deportiva Alajuelense is banking on a favorable ruling from the CAS in their dispute with FIFA.
The Fédération Internationale de Football Association (FIFA), the global governing body for football, is navigating a contentious situation involving Liga Deportiva Alajuelense as it prepares for the upcoming World Club Cup.

On April 1, FIFA announced plans to arrange a substitute match between Club América of Mexico and Los Angeles FC from Major League Soccer (MLS) should León be expelled from the tournament.

This decision has incited discontent among Alajuelense officials, who seek to secure their participation in the event scheduled for June and July in the United States.

Alajuelense's hopes hinge on a ruling from the Court of Arbitration for Sport (CAS), set to hold hearings on April 23, to affirm their claim to a rightful place in the tournament.

In a statement issued by FIFA, it was made clear that while the organization supports the proposed match between Club América and Los Angeles FC, it remains obligated to adhere to any ruling from the CAS, as its statutes recognize the authority of the tribunal in resolving disputes involving FIFA and its member federations.

"FIFA acknowledges the Court of Arbitration for Sport (CAS) based in Lausanne, Switzerland, as the adjudicator for disputes involving FIFA and its member federations, confederations, leagues, clubs, players, officials, football agents, and match organizers," the organization stated.

Previous instances have demonstrated that the CAS has effectively challenged FIFA's decisions.

Notably, in 2022, the CAS allowed the Ecuadorian national team to compete in the FIFA World Cup despite FIFA's sanctions related to player Byron Moreno, which had threatened Ecuador's participation.

The CAS's ruling resulted in a reduced penalty of three matches and a fine for future eliminations, which Ecuador subsequently served in the 2024 qualifying rounds.

Additional precedent for CAS's influence includes the 2018 case of Chung Mong-joon, a former FIFA vice president, who successfully appealed against a five-year ban and 50,000 Swiss franc fine imposed by FIFA.

The CAS not only revoked the ban but also reduced the sentence to 15 months.

Similarly, Real Madrid overturned a FIFA-imposed transfer ban in 2016 through the CAS, which modified the punishment to a mere financial penalty, allowing the club to continue its player acquisitions uninterrupted.

As the scheduled CAS hearing approaches, Alajuelense is poised to present its case, hoping to replicate the fortunes of previous clubs and federations that have successfully navigated disputes with FIFA.
